TOWN OF WEATHERSFIELD, VERMONT
PLANNING COMMISSION
Monday, December 10, 2007

I. Roll Call:
Commission members present were Peter Daniels, Julia Schmitz, Bruce Cox, and deForest Bearse (Land Use Administrator)

The audience members present were Carl Wyman and Michael Todd.

Peter Daniels called the meeting to order at 7:02.

II. Approval of Minutes: Meeting of November 12, 2007
Julia Schmitz made a motion to accept the minutes. Bruce Cox seconded it. All were unanimous to approve the minutes with many corrections.

III. Public Hearings:
There were none.

IV. Reviews:
A. Request from Carl Wyman for a conditional certificate of occupancy for office building/apartment at Downers 4 Corners
Carl Wyman stated that the office should be ready for occupancy the first week of January. The apartment will be ready later in the spring. Due to time restrictions, he was unable to plant the birches or lilacs. He will do that in the spring. He stated that it would be next to impossible as a land owner to put up a $10,000 bond. He is confused about the bond requirement. deForest Bearse stated that the bond would ensure that the work would get done in a timely manner. Carl Wyman understands about the landscaping, but wants to know what the concerns are with the inside work. The apartment needs painting, carpet, light fixtures, cabinets, and doors. It has heat and plumbing. deForest Bearse asked if the apartment was clearly divided from the office. Carl Wyman said that it is. The apartment must be finished sufficiently so it is obviously an apartment for the conditional certificate of occupancy to be issued.
Julia made a motion that the Commission allow a conditional certificate of occupancy for six months from the date the surety of $500 is posted that the landscaping will be completed. On the determination of the administrator officer that the landscaping is completed, she will authorize the release of the surety and issue a certificate of occupancy. Bruce Cox seconded it. All were unanimous.

V. Public Comment:
Michael Todd, owner of Hawks Mountain Motor Sports, wanted to know what it would take to have a zoning change in the area by Kendrick’s Corners. He currently operates under a home industry and is in the process of buying property that borders his property. deForest Bearse informed him that he could get a petition signed by voters and present it to the Selectmen to have the Commission look at the zoning change, or the Commission could look at it voluntarily. If a grant comes through, the Commission will be looking at zoning changes in the next few years.





VI. Other:
The Commission picked either February 25th , or March 17th to have the VLCT workshop.

Peter Daniels signed the mylar for the Johnson estate.

The Commission discussed 6.10.2.

The Commission members should read over the subdivision regulations. The Commission would like to discuss the Conservation Commission (what would be useful information in subdivision and site plan) at a meeting.

VII. Adjournment:
Julia Schmitz made a motion to adjourn at 8:40. Bruce Cox seconded it. All were unanimous to adjourn.
