TOWN OF WEATHERSFIELD, VERMONT
PLANNING COMMISSION
Monday, November 14, 2011

I. Introductions:

Commission members present were Michael Todd, Ed Williams, Bruce Cox, Alan Hudson, Gil Whittemore, Julia Lloyd Wright (ex-officio), and deForest Bearse (Land Use Administrator).

The audience members were Gary Rapanotti and Chris Harris.

Bruce Cox opened the meeting at 7:00 PM.

II. Approval of Minutes: Meeting of October 24, 2011

Michael Todd made a motion to approve the minutes of October 24, 2011 with corrections. Ed Williams seconded it. All were unanimous.

III. Review Meeting Agenda - additions, correction

Diana Day submitted her resignation as secretary.

IV. Public Hearings:
A. Final Plat Reviews-
#10.2422 by Fire LLC for subdivision of 50.88 acres of land at 126 Beaver Pond Road into 3 lots
Bruce Cox opened the hearing at 7:02 PM. Gil Whittemore would like this moved it II on the agenda. Alan Hudson seconded it. All were unanimous. There has been no exparte communication.
Gary Rapanotti is representing the land owner. Chris Harris is representing the Weathersfield Conservation Commission. Gary Rapanotti and Chris Harris affirmed. Gary Rapanotti stated that the plan is the same as last time. deForest Bearse stated that the Commission wanted curb cuts permit and a letter from the fire department stating they could provide services. deForest Bearse stated that the curb cuts permits have been granted. She did not receive a letter from the fire department. The Commission stated that it has no concerns with the fire access. Julia Lloyd Wright wanted to know why the for sale signs are up already. The Commission stated that even if the signs were up, a sale could not be finalized until the subdivision has been finalized.
Chris Harris, Weathersfield Conservation Commission, referred to the Weathersfield Conservation Commission letter dated February 6, 2011. The Commission does not want the land broken up for development. They would like it kept as a whole. There are not just natural features on the property, but historical features. It has been a working farm on and off. It would be a loss to the town. Ed Williams stated that the Weathersfield Conservation Commission could attempt to purchase the property. Gil Whittemore stated that the Weathersfield Conservation Commission could investigate whether the Land Trust might purchase all three parcels or development rights. If the subdivision meets all the subdivision regulations, the Commission cannot stop it. There is no legal basis to deny this permit.
Gary Rapanotti will pass the information along to the land owner. deForest Bearse stated that there are no prime agricultural land or protected soils on this property. The buildings are on the historic site list for the Town. Gary Rapanotti showed the Commission where the pins are located and where they are going to be set. The Commission showed Gary Rapanotti where they would like additional pins to be placed. Michael Todd made a motion to close the hearing at 7:40 PM. Alan Hudson seconded it. All were unanimous. Michael Todd made a motion to approve the final plat with the understanding that before the mylar is signed that the pins are set and noted on the mylar. Alan Hudson seconded it. All were unanimous.
Gary Rapanotti stated that he hopes that everyone that comes after Mr. Manafort has to go through the same process as Mr. Manafort.


IV. Discussions:

A. Bylaw/Regulations Revisions

(1) Interested Persons
The Commission discussed the language and deleted the number 6. deForest Bearse will have the report and the final language for their next meeting.

(2) Height Limit-final language
The Commission reviewed the final language and made minor changes. deForest Bearse will present the Commission with the final language and the report. The Commission will review it at their next meeting.

(3) Nonconforming Uses-final language
The Commission reviewed the final language. deForest Bearse will have the report for the Commission at the next meeting.

(4) Fluvial Erosion Hazard Overlay
The Commission will ask John Broker Campbell, SWCRPC, to come to a meeting in 2012 to discuss this.

B. Town Plan Revisions
(1) Energy Chapter
The Commission reviewed the chapter. Comments are in red. deForest Bearse stated that the policies came from Julia Lloyd Wright. The Commission members will review the energy chapter and have comments ready for their next meeting.

C. Town Report
D. Budget
E. Update on bylaw changes (6.2, 6.5, 6.10,.1, 7.18)


VI. Public Comment:

There were none.

VII. Set or reinforce the agenda, date, time, and place for the next meeting

The Commission will review 9.9.3, height limits, and nonconforming uses wording and the reports that go with each.

VIII. Adjournment:
Ed Williams made a motion to adjourn at 8:55PM. Michael Todd seconded it. All were unanimous.
