Zoning Board of Adjustment July 14, 2010 Meeting Minutes DRAFT I. Roll Call Board members present at the meeting were Graham Hunter, David Gulbrandsen, Debbie Graham, and Barbara Ingalls. Land Use Administrator deForest Bearse was also present.
There was Keith Graham and Joshua Gilman in the audience.
The Board did a site visit prior to the meeting. Everyone listed above was at the site visit. David Gulbrandsen called the meeting to order at 7:00.
II. Additions & Corrections The Board needs to sign the approved Rules of Procedure and the Ethics Policy.
III. Approval of Minutes: April 28, 2010 Graham Hunter made a motion to move approval of the minutes to after the public hearing. Barbara Ingalls seconded it. All were unanimous. Graham Hunter made a motion to approve the minutes of April 28, 2010 as written. Barbara Ingalls seconded it. Graham Hunter, Barbara Ingalls, and David Gulbrandsen vote yes to approve the minutes as written. Debbie Graham abstained.
IV. Public Hearings (1) Variance hearing for app. #06.2410 by Joshua Gilman for single family home on Skyline Drive David Gulbrandsen opened the hearing at 7:02. Joshua Gilman was put on the record as being an interested party. Joshua Gilman and deForest Bearse affirmed. deForest Bearse stated that on the site plan it shows a 24 foot side setback on both sides. There is a 50 foot minimum required setback, so she referred this to the ZBA for a variance. It is .67 acres with an 84 foot frontage. It is a pre-existing lot. Joshua Gilman stated that the two story house will be 28 feet by 50 feet with a deck of 8 feet by 24 feet. It is centered in the property and will include a one bay attached garage. It is located in the front due to the poor site conditions in the back. He is limited due to the State septic location. He will put fill in the front, so it will go up to the same street level. David Gulbrandsen asked if he had considered moving it a 90 degree rotation with the end of the house facing the road. Joshua Gilman said that the house would then be over the trench drain and he would still need a variance. He would be leaving the areas on the sides of the house as vegetation to limit the neighbor's visibility. He will be using boulders on site for retaining walls behind the house. The permit is pending for his mound system septic. He wants to keep the house and garage together to minimize the impact. He had conversations with the highway superintendent and he cannot move the culvert. Joshua Gilman stated that the Eaglestone's property wraps around to the west side. He has just two abutters. deForest Bearse stated that the abutters were notified of this hearing. She did not receive any communication from them. Joshua Gilman stated that the shield is for the isolation of the septic. The seasonal culvert will be channeled to the back of his property so it does not interfere with his driveway. The back of his property is wet due to the discharge from the culvert. He bought the property in December 2009 from someone other than the abutters. The Board went over the checklist. They witnessed that the lot size is long and narrow. Graham Hunter read Section 6.2.1 of the Bylaws. Exhibit 1 will be the application which includes the site plan and the site plan requirements. Barbara Ingalls made a motion to close the hearing at 7:37. Debbie Graham seconded it. All were unanimous to close the hearing.
II. Public Comment There was none.
III. Other Business The Board members signed the Rules of Procedure and the Ethics Policy. Westley Hazeltine submitted his resignation to deForest Bearse. She will submit it to the town manager. David Gulbrandsen will be sending him a letter of thanks.
IV. Adjournment Graham Hunter made a motion to adjourn the meeting at 7:50. Barbara Ingalls seconded it. All were unanimous to adjourn.
