6.2 Nonconforming Lots and Parcels: (as required by Sect. 4412 of The Act) 6.2.1 Existing Small Lots: Current Language Lots in individual and separate and nonaffiliated ownership from surrounding properties in existence on the effective date of these Bylaws (see Definitions), may be developed for the purposes permitted in the district in which they are located, even though not conforming to minimum lot size requirements, if such lots are not less than one-eighth acre in area with a minimum width or depth dimension of forty (40) feet, provided the plans for any proposed water and sewage provisions comply with applicable state and town regulations. A variance shall be required if the district basic minimum requirements cannot be met. In addition, small lots that have gone through the subdivision process and have been recorded with the Town Clerk prior to the adoption of this section (January 4, 1994) may be developed for the purposes permitted in the district in which they are located.
