Dear Town Official,

The first day of summer is just around the corner which means a range of festivals and town-wide events will be taking place and organizations will be looking for ways to advertise. This is a reminder that it is illegal to hang banners or signs above State highways or anywhere within the highway right-of-way (minimum of 25’ from centerline of road).

Title 10 of the Vermont Statutes Annotated outlines the laws regarding signs and highway right-of-way. 10 V.S.A. §495 (d) states “Notwithstanding any other provisions of this title, a person, firm or corporation shall not erect or maintain any outdoor advertising structure, device or display within the limits of the highway right-of-way”. There are absolutely no exceptions to this law for banners hung above State maintained highways regardless of the type of event being advertised or the length of time the banner is displayed (10 V.S.A. §495 (e)).

Any illegally placed banners will be removed in accordance with 10 V.S.A. §497.
